1. Acceptance of Terms

By accessing and using the Care Compliance System ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

The Care Compliance System is a healthcare compliance management platform designed to help organizations manage audits, action plans, incidents, maintenance logs, and feedback in accordance with regulatory requirements including CQC standards.

3. User Accounts and Access

  • Access to the Service is by invitation only. There is no public registration system.
  • Only authorized administrators can invite users to join the platform.
  • Users are responsible for maintaining the confidentiality of their account credentials.
  • Users must notify administrators immediately of any unauthorized use of their account.
  • Account access is subject to role-based permissions as assigned by administrators.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Transmit or upload any content that is harmful, threatening, abusive, or otherwise objectionable
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Share your account credentials with unauthorized individuals
  • Use the Service to store or transmit malicious code

5. Data and Content

  • You retain ownership of all data and content you submit to the Service.
  • You grant us a limited license to use, store, and process your content to provide the Service.
  • You are responsible for ensuring the accuracy and legality of all content you submit.
  • We reserve the right to remove content that violates these Terms or applicable laws.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Service is designed to comply with GDPR and HIPAA requirements where applicable.

7. Data Retention

We maintain the following data retention policies:

  • Audit Records: 7 years
  • Incident Reports: 5 years
  • Task History: 3 years
  • User Activity Logs: 1 year
  • File Attachments: Per-record setting as configured

8. Service Availability

While we strive to maintain high availability, we do not guarantee that the Service will be available at all times. We may experience downtime for maintenance, updates, or due to factors beyond our control.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

11. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees).

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever including breach of these Terms.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

14. Governing Law

These Terms shall be interpreted and governed by the laws of England and Wales, without regard to its conflict of law provisions.
